Terms of Service
1. Agreement and Apple license
By creating an account, purchasing a subscription, or using Sourcerer (the “Service”), you agree to these Terms and acknowledge the Privacy Policy. If you do not agree, do not use the Service. You must be at least 18 years old and legally able to enter this agreement. The Service is intended for users in the United States.
The iOS app is licensed under Apple’s Standard End User License Agreement. These Terms supplement that agreement for Sourcerer-specific accounts, subscriptions, features, and content. Apple’s agreement controls if there is a conflict concerning the license to use the iOS app.
2. Service, marketplace listings, and Deal Wizard
Sourcerer helps users find and evaluate third-party marketplace listings and may provide searches, notifications, Deal Wizard filtering, favorites, feedback, and inventory and profit-tracking tools. Sourcerer is not affiliated with or endorsed by Meta, Facebook, Facebook Marketplace, or marketplace sellers.
Sourcerer does not create, own, sell, inspect, or verify listed items and is not a party to transactions. Listings may be inaccurate, unlawful, unsafe, unavailable, or unprofitable. You are responsible for reviewing listings, sellers, ownership, condition, safety, and any transaction you choose to complete.
Deal Wizard uses automated systems and artificial intelligence to interpret your instructions and feedback. Matches, rankings, descriptions, and recommendations may be incomplete, inaccurate, delayed, or unsuitable and are not financial, legal, tax, investment, safety, or professional advice. Do not submit passwords, government identifiers, payment-card information, or other sensitive information to Deal Wizard.
3. Accounts, user content, and acceptable use
You may need an account with a verified phone number. Keep your account and device secure, provide accurate information, and contact support about suspected unauthorized access. You retain ownership of searches, instructions, feedback, inventory records, photographs, locations, notes, and other content you submit. You grant Sourcerer a limited, nonexclusive license to process that content only as needed to operate, secure, personalize, maintain, and improve the Service.
Do not use the Service unlawfully or fraudulently; access another person’s account; upload malicious content; violate privacy, intellectual-property, or contractual rights; disrupt or probe the Service; bypass subscriptions or security; or scrape, reverse engineer, copy, resell, or commercially redistribute Sourcerer data or functionality without permission.
4. Subscriptions, cancellation, and refunds
Sourcerer Pro may be offered as monthly, six-month, or yearly auto-renewable subscriptions. The price, billing period, trial eligibility, and included features are shown before purchase. Apple processes purchases through your Apple Account; Sourcerer does not receive your complete payment-card number.
An eligible free trial converts to the selected paid subscription unless canceled at least 24 hours before it ends. Subscriptions renew automatically unless canceled at least 24 hours before the current period ends. Deleting the app or your Sourcerer account does not cancel an Apple subscription.
Manage or cancel through Sourcerer or Apple Subscriptions. Cancellation normally takes effect at the end of the current billing period, and access generally continues until then. Apple handles refund decisions through Report a Problem. Prices may change subject to Apple’s required notice and consent procedures.
5. Intellectual property and third-party services
Sourcerer’s software, branding, interface, designs, and original content belong to Matthew Blake or applicable licensors. These Terms give you only a limited right to use the Service. Suggestions may be used without restriction or compensation. Third-party platforms, sellers, AI providers, maps, links, and services have their own terms and policies, and Sourcerer is not responsible for their availability, products, content, or conduct.
6. Availability, suspension, and deletion
The Service may change, experience interruptions, or be discontinued. We may limit or terminate access for material violations, fraud, abuse, security or legal risk, or nonpayment. You may delete your account through the in-app settings. Deletion is subject to the limited retention described in the Privacy Policy and does not cancel an Apple subscription.
Provisions that by their nature should survive termination—including intellectual property, warranty disclaimers, liability limitations, indemnification, and governing law—remain effective after termination.
7. Warranties, liability, and indemnification
To the fullest extent permitted by law, the Service is provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, accuracy, availability, or noninfringement. We do not guarantee uninterrupted service or accurate listings, notifications, AI output, or calculations.
To the fullest extent permitted by law, Matthew Blake and Sourcerer are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, opportunities, or data or losses involving third-party listings or transactions. Total liability for claims arising from the Service will not exceed $50. These limits do not apply to gross negligence, willful misconduct, fraud, or liability that cannot legally be excluded or limited.
To the extent permitted by law, you agree to defend and indemnify Matthew Blake and Sourcerer against third-party claims resulting from your unlawful misuse of the Service, violation of these Terms, submitted content, or infringement of another person’s rights, except to the extent caused by Sourcerer’s unlawful conduct.
8. Changes to these Terms
We may update these Terms when the Service, law, security requirements, or business practices change. We will update the date below and provide additional notice when reasonably required. Continued use after revised Terms take effect constitutes acceptance to the extent permitted by law.
9. Governing law and general terms
Florida law and applicable United States federal law govern these Terms, without regard to conflict-of-law principles. Before filing a claim, contact us and allow a reasonable opportunity for informal resolution. Unresolved disputes may be brought in a court with jurisdiction in Florida unless applicable consumer law requires otherwise. If a provision is unenforceable, the remaining provisions continue in effect. Failure to enforce a provision is not a waiver, and these Terms may be transferred with a restructuring, sale, or transfer of the Service.
